Subject: Public Procurement and Disposal Act, 2005

THAT, aware that the Public Procurement and Disposal Act, 2005, requires that each Public entity establish procedures to provide for the making of decisions on behalf of the public entity relating to procurement; further aware that on 25th March, 2013, the Minister for Finance gazetted the Public Procurement and Disposal (County Government Regulations) as Legal Notice No. 60 of 2013 enacting guidelines to be followed by the County Governments when carrying out procurement processes within the county; deeply concerned that public procurement processes within the County Government are bureaucratic in nature and there isn’t enough personnel to handle the workload, resulting in delays in implementation of public projects and attracting unnecessary extra costs that are met by taxpayers across the City; this Assembly resolves that the County Government move with speed and ensure that procurement process within the County is decentralized to the respective existing departments or entities of the county government in order to expedite the procurement processes and implementation of projects within the stipulated time and at a reasonable cost.
