THAT, aware that the functions of Planning and Housing are vested to county governments pursuant to Paragraph 8 of Part Two of the Fourth Schedule to the Constitution; further aware that the Nairobi City Government plans to construct modern houses within the County to accommodate more homebuyers; concerned that County Government officials have been inhumanely evicting tenants found to have defaulted in rent from the County houses without following due procedure and instead letting them out to their friends and cronies; noting that this flagrant abuse of the law has visited untold suffering on the concerned residents of Nairobi, this Assembly resolves that the County Government follows due procedure when undertaking evictions on purely humanitarian grounds and give the affected tenants a chance to pay their arrears before resolving to evict them and move with speed to develop the appropriate legal framework that will deal with all aspects of management of County houses.
